These Terms apply when you visit, create an account for, buy credits for, or use SocialListeningAPI.

1. Who we are

SocialListeningAPI is a product offered under Mentionkit. Mentionkit is a registered business name of Nazare Studios Pty Ltd, an Australian private company based in Victoria, Australia.

In these Terms, “SocialListeningAPI,” “we,” “our,” and “us” mean Nazare Studios Pty Ltd and the SocialListeningAPI website, application, APIs, and related services. “You” means the person or business using the service.

2. Accepting these Terms

By using SocialListeningAPI, you agree to these Terms and our Privacy Policy. If you use the service for a business or another organization, you confirm that you have authority to accept these Terms for it.

You must be at least 13 years old and legally able to enter into this agreement. You must provide accurate account information and keep it up to date.

3. Your account

You are responsible for activity under your account and for keeping passwords, API keys, and other access details secure. Do not share access outside your authorized users or use another person’s account without permission.

Tell us promptly if you believe your account or API key has been accessed without permission. We may suspend access while we investigate a security or billing issue.

4. Credit packs and API usage

SocialListeningAPI uses prepaid credit packs rather than a recurring subscription.

• Each credit pack is a one-time purchase.
• Credits are added to your workspace after payment is confirmed.
• API use deducts credits from your workspace balance at the rate shown in the product or documentation when the request is made.
• Purchased credits do not expire while your account and the service remain available.
• Credits have no cash value, cannot be transferred outside your workspace, and cannot be resold.
• You must have enough credits for any request that carries a credit cost.

We may change pack sizes, prices, or the credit cost of future API use. A change will not reduce the number of credits already in your balance. Prices are in US dollars unless we clearly state another currency.

5. Payments and refunds

Payments are processed by Stripe. You agree to provide accurate billing information and authorize the one-time charge for credit packs shown at checkout.

Credit pack purchases are final. Providing credit packs and API access creates payment processing, infrastructure, and third-party data costs for us, so refunds are not available. This includes unused or partly used credits, changes of mind, accidental over-purchases, and credits left when you close your account.

This policy does not exclude, restrict, or modify any consumer guarantee, right, or remedy that cannot lawfully be excluded, including rights under the Australian Consumer Law. If the law requires a refund or another remedy, we will provide it.

6. Acceptable use

You must not use SocialListeningAPI to:

• Break the law or infringe another person’s rights, including privacy and intellectual property rights.
• Collect, store, or disclose information unlawfully.
• Send spam, harassment, threats, or deceptive messages.
• Introduce malware or try to gain unauthorized access to an account, system, or network.
• Interfere with the service, bypass limits, or avoid credit charges.
• Reverse engineer, copy, resell, or provide unauthorized access to the service, except where the law allows it.
• Use the service or its data to train or build a competing product without our written permission.
• Misrepresent the source, meaning, or ownership of public content returned by the service.

You are responsible for deciding whether your use of public content and API results is lawful and appropriate.

7. Your content and our intellectual property

You keep ownership of content you submit to SocialListeningAPI. You give us a non-exclusive, worldwide, royalty-free licence to host, process, copy, and display that content only as needed to provide, secure, support, and improve the service.

We and our licensors own SocialListeningAPI, including its software, design, branding, documentation, and original content. These Terms give you a limited, non-exclusive, non-transferable right to use the service while you comply with them.

If you send feedback or feature ideas, you allow us to use them without restriction or payment.

Copyright or removal requests can be sent to shash@mentionkit.com. Include the source URL, a clear description of the material, your contact details, and why you believe it should be removed.

8. Service changes and availability

We may add, change, limit, or remove features and supported sources. We may also pause the service for maintenance, security, legal, or operational reasons.

We work to keep SocialListeningAPI reliable, but no online service or third-party data source is available all the time. Results may be delayed, incomplete, duplicated, or removed when source platforms change.

9. Suspension and account closure

We may suspend or close your account if you breach these Terms, create a security risk, fail to pay a valid charge, misuse the service, or expose us or another person to legal harm.

You may stop using SocialListeningAPI and close your account at any time. When an account is closed, access to unused credits ends and those credits are not redeemable for cash or refundable, except where required by law.

We may retain limited records after closure where needed for legal, tax, billing, fraud prevention, security, backup, or dispute purposes, as explained in our Privacy Policy.

10. Disclaimers and liability

To the maximum extent allowed by law, SocialListeningAPI is provided on an “as available” basis. We do not guarantee that the service will meet every need, find every mention, or produce error-free results.

Nothing in these Terms excludes a guarantee, right, or remedy that cannot lawfully be excluded. Where the law allows us to limit liability, our total liability arising from the service or these Terms is limited to the amount you paid us in the 12 months before the event giving rise to the claim.

To the maximum extent allowed by law, we are not liable for indirect, incidental, special, or consequential loss, lost profits, lost revenue, lost data, or loss caused by a third-party service.

11. Changes to these Terms

We may update these Terms when the service, pricing model, or law changes. We will post the updated Terms here and change the “Last updated” date. If a change materially affects your rights, we may also give notice through the service or by email.

12. Governing law

These Terms are governed by the laws of Victoria, Australia. You and we submit to the non-exclusive jurisdiction of the courts of Victoria.

If one part of these Terms is unenforceable, the rest continues to apply. These Terms and the Privacy Policy are the entire agreement between you and us about SocialListeningAPI, unless we agree to additional terms in writing.
